What this means is that & Let s consider a Swedish company that imports electronics from other European countries needs the knowledge of the Part of the CISG as well... If it chooses to import goods from Spain& If it instead chooses to import the goods from Estonia, the Part II of CISG applies BUT the contract may only be changed in writing due to the Estonian reservation in accordance of art. 96 of the CISG. Finally, even if it chooses to import the goods from Island, a fellow Nordic country, Part II of the CISG will apply since the Island has made no reservations in its ratification of the CISG. Depending on which of the Nordic countries the Spanish company chooses to import the goods from, it will face three different versions of the CISG If it chooses to import Norwegian salmon... If it instead chooses to import Finnish pike... Finally, if it chooses to import Islandic trout...HV  G       H t 0g ? ̙330  xh(  x^ x S XAx    x c $qX ;~   ^JLet's move on and take a look at the material CISG rules and principles...H x 0g ? ̙338  0   `| (  |^ | S XAx     | c $8IX ;~   ~ zLets then talk about one of the fundamental problems with the application of the CISG throughout the world: the need to uniformity in interpretation. Lack of uniformity in application of the CISG represents a threat to the existence of the CISG. Unless the applicability is uniform throgout the world, what's the point in having a international convention? The extent of this problem is obvious when we again take a look at the map of the contracting states to the CISG& This matter is addressed in the Convention itself... The practical implication of the need for uniform application is that the lawyers dealing with the CISG need to spend time on tracking, obtaining and analyzing information concerning the international case law on the interpretation of the CISG. Before we will take a look at some ways to do this jobs efficiently, let s talk about the particular problems that concern the uniform application of the CISG in a Norwegian context.F "5   H | 0g ? ̙33 0 m(  ^  S XAx     c $X ;~   cOOne practical solution to the problem of uniformity is offered by the use of...H  0g ? ̙330 p`(  d c $Ax    3 r5u5u ;~   When it comes to uniformity of CISG application, Norway has quite unique problems due to the fact that CISG was not incorporated but transformed to a national act that has little resembleness with the original version. The judges and arbitrators are therefore faced with a particularly demanding task concerning the interpretatation of that national act in uniformity with the international application of the CISG. This Norwegian dilemma leads us to several questions& - The advocates for the contract parties should pay particular interested in the uniformity of the application of the Norwegian SGA in relation to the international applicaiton of the CISG. - Yes, lawyers are trained to deal with practical problems of intepretation so it is possible but the costs are surely unnecessary high. - Norway has infact recently patched its implementation concerning a specific problem that has been strongly critized by Norwegian academics but it seems that there are no plans of abandoning the choice of transformation technique. It is amazing that the Norwegian legislator does not seem have bothered to consider the practical problems and costs that foreign contract parties naturally have in obtaining the necessary information of the Norwegian transformation of the CISG. It has also been pointed out by some Norwegian academics the application of the Norwegian SGA in international contracts might infact be a disadvantage to Norwegian contract parties concerning the material solutions chosen by the Norwegian legislator. Luckily, of all the 62 countries that have implemented the CISG, only Israel has followed Norwegian transformation technique. Otherwise the whole point in having a international sales convention would be greatly jeopardized as the uniformity of the international sales law is the whole essence of the convention. - Yes, they should consider thoroughly the need to choose Norwegian law as the law of the contract, but the answer is naturally not that simple and has to be answered in the context of the specific contract. - When entering a contract the contract parties really need to understand the default norms that the contract will be governed by and therefore the choice is obviously yes; I would recommed contract parties that do not have adequate Norwegian knowledge to choose the original CISG-text instead of the Norwegian transformation.L L  4     %Q563 %   26 4    K :%      + #)  $)   %  ,H  0g ? ̙33 0  |  (  ^  S XAx   v   c $X ;~   Let s talk first about the inter-Nordic reservation, which is based on the wish to preserve the& This uniformity is namely no longer so obvious as it was thought to be. We will take a short look at the legislative history of the the Nordic sales laws. The basis for the uniformity of the Nordic Sales laws was laid down in 1905-1907 when the Scandinavian Sales of good acts were formed in co-operation between the Scandinavian countries. At that time the sales law of Finland was based on an old Sales Act of 1734 and customary law. The next fase in the Nordic uniformity was lauched by the& This diversity of the Nordic sales law has lead some academics to question the legimity of the reservation as such. The fact that I am not using that term is due to the cultural background of these countries. After all the Finnish language is not memeber of the Scandinavian language family. I will instead refer to these countries as  Nordic-mainland , not only because of the geografical reasons but also due to the fact that Denmark chose to rule out its atlantic regions, Greenland and the Faroe Islands from the CISG-regime. These countries implemented the CISG as their international sales during the years 1989 and 1990. I will use the following illustration that is found in the Pace University database on CISG and International Law as the starting point. As I mentioned earlier, 62 countries representing all of the continents of the world have ratified the CISG. In economic terms this means that the CISG is the& There are however a large number of countries that have so far chosen to stand outside the CISG-family. The& The reasons for these countries to stay outside the CISG-regime are naturally various. When it comes to the United Kingdom it is commonly understood that the british lawyers are concerned that the ratification of the CISG would endanger the competitive advantages that british law firms and arbitrations courts have at the time being due to the fact that English law is one of the most often chosen laws of the contract. Commercial contracting and dispute resolution is big business in U.K. and the resistance against the CISG is obvious. It is however believed that even U.K will become a member of the CISG-family in the future. (              XA !
